By accessing or using our website or engaging Studio Sunsette for creative services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please discontinue use of our website and services immediately.

1.3 Services
Studio Sunsette LLC provides creative and digital design services according to the scope of work and timelines agreed upon with each client. All projects are delivered based on an approved proposal or written agreement outlining project details, deliverables, and payment terms.
1.4. Payments
All payments must be made in accordance with the payment schedule agreed upon at the start of the project. Payments are accepted via Stripe or other approved payment methods. A non-refundable deposit may be required to secure your project. Work will not begin until the deposit is received. Late payments may result in delays or suspension of ongoing work.
1.5. Refund Policy
1.5.1. Digital Products and Downloads
All digital downloads, design templates, or digital materials purchased from Studio Sunsette are non-refundable once delivered. Refunds will only be considered if the digital product was not delivered or is proven to be defective.
1.5.2. Custom Creative Services
Due to the nature of creative and time-based work, payments for design, branding, and web development services are non-refundable once work has commenced. Refunds will only be granted if no work has been completed at the time of cancellation. Deposits are strictly non-refundable.
1.6. Intellectual Property
All original creative work, concepts, and materials produced by Studio Sunsette remain our property until full payment is received. Once full payment has been made:
You are granted ownership of the final deliverables for your intended business use.
Studio Sunsette retains the right to display completed work in our portfolio, marketing materials, and social media for promotional purposes.
Any unused concepts, drafts, or preliminary materials remain the intellectual property of Studio Sunsette LLC.
1.7. Client Responsibilities
You agree to provide accurate information, timely feedback, and all necessary materials required for the successful completion of your project. Delays in client response or failure to provide required materials may result in timeline adjustments and additional fees.
1.8. Limitation of Liability
Studio Sunsette LLC will not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website. We make no guarantees regarding specific business outcomes, sales, or results following delivery of our creative work.
1.9. Third-Party Tools and Services
We may use third-party software, plugins, or hosting services to deliver our work. Studio Sunsette is not responsible for issues arising from third-party platforms, integrations, or tools outside our control.
1.10. Governing Law
These Terms are governed by and interpreted according to the laws of the State of New Mexico, United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Mexico.
